Terms of Service

Introduction
            This Service Terms and Service Agreement will governs the relationship of Loyal Server InfoTech Private Limited India (i.e.: "Service Provider, We, Us"), its servers and systems and its resources (i.e.: "Service we offer"), and any entity that is explicitly granted use of the Service (i.e.: "Subscriber, Client, You").
Terms of Termination:
            Your account will be terminated immediately with or without notifying you if you do any of the below banned activities in your account.
            Actions like,

• Child abuse / Pornography, Sick Pornography
• Usage of IRC Bots / Card way / Doorway
• Streaming Services like OBS (Open Broadcasting), CDN (Content Delivery Network).
• Activities that leads to spamhaus listings
• Logging into Phishing sites, Spam Sites, Proxy Sites.
• Installing a VPN.
• Executing scripts that originates DDoS attack.
• Archiving files on Multiple instance at same time
• Bitcoin Mining

Billing and Invoicing:

• Prices listed on the website doesn't include Goods and Service Tax (TAX) or any other Taxable Charges. It may or may not be reflected on the billing based on the user origin country.
• Indian users are entitled to pay GST along with the service invoice.
• Payment for the services are made in advance by clients.
• Invoice Unpaid Remainder will be sent 10 days prior to due date.
• If the payment for any service is not received on or before the due date, services will be suspended immediately.
• For first time, once the payment is complete the details are mailed to the registered mail id as mentioned in invoice.
• The products that are offered by us are purely virtual. No hardware’s will be delivered to you.
• The invoice due date will be same as the date of activation of the service.

Indemnification
You agree to indemnify, defend, and hold Loyal Server InfoTech Private Limited and its affiliates, founders, officers, employees, and agents harmless from and against any liabilities, losses, damages or costs, that includes any third-party claim, action, dispute, or demand related to your use of the services, your violation of any of the provisions of this agreement.
Customer agrees to defend, indemnify and hold harmless Loyal Server InfoTech Private Limited liabilities arising out of any injury to person or property caused by any products sold or otherwise distributed in connection with Loyal Server InfoTech Private Limited's server.                    

Resource Usage Policy:
Bandwidth Usage:
All the servers we provide to the client comes with the ample amount of bandwidth for use. We have every right to modify, upgrade or downgrade this if it affects the server performance or efficiency.
Memory usage:
We reserve the right to monitor the usage of resource on Processor/RAM. We have every right to suspend the user account (Temporally/Permanantly), if resource abuse has been found.
Unsorted:

• No backup is provided to your files under our services. You use our services at your sole risk. We do not responsible for any data loss in your server.
• Client should take care of their server and the files stored by them in it. If your action’s in the account leads to hardware failure, necessary charges will be charged to you.

Refund Policy:

• No refund is given for Domain registration and Web designing.
• Refund for services like RDP (Remote Desktop Connection), VPS (Virtual Private Server) and Seedbox are valid only for 24 Hours after delivery of the Service.
• No refund will be provided for Dedicated Servers orders.
• Any amount that has been added to Credit balance can be used only to use our services, that amount will not be refunded at any cost.
• Dedicated server orders are processed on the basis of Pre-Pay mode. Cancellations on any servers should be done before 7 days of Due date.
• If we can't able to refund you amount on the default payed gateway, we will add that amount to your credit balance. You can use that amount to use our services.
• If you downgrade your service on middle of your service period, refund will not be given. The price of the new plan you have chosen will be reflected only on next invoice.
• Your refund request will be cancelled, if you open any dispute using PayPal or Your Card issuer or through any third party.
• If any user use our services that doesn't meet our Terms and Condition or Spam Policy or misusing our Privacy Policy, no refund will be given.
• We reserve our right to deny you refund request or provide a partial refund.

DMCA Policy:
We respect the intellectual property rights of others just as we expect others to respect our rights. Pursuant to Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), a copyright owner or their agent may submit a takedown notice to us via our DMCA Agent listed below. As a hosting service provider, we are entitled to claim immunity from said infringement claims pursuant to the “safe harbor” provisions of the DMCA. To submit a good faith infringement claim to us, you must submit notice to us using our contact email id or support system.
We, Loyal Server InfoTech Private Limited India have every right to modify these terms with or without any prior notification to clients. On behalf of modification, any existing or new customers should comply with those terms

Privacy Policy:
            This agreement is between Loyal Server Infotech Private Limited India (i.e.: "We, Service Provider") and the client (i.e.: "You, User").

• We collect information from our client by using a form. It contains the basic information regarding the client. It is stored and used for future purpose.
• We will use your mail id to promote our brand services that may interest you. However you may unsubscribe from this mailing list whenever you feel as it is.
• We will not give your information to any third party unless it is a legal issue.
• We will not spam your inbox at any state.
• We will not store any of your Credit/Debit card details, we respect your privacy to the core in this matter.
• We use cookies to track how the users use our website (http://www.loyalserver.com).
